By booking surprise proposal photography services, the Client agrees to the following Terms & Conditions.
1. Booking & Payment
- A signed agreement and a non-refundable retainer of $100 is required to reserve the date.
- The remaining balance is due the day of proposal date.
- Dates are not held without a signed contract and retainer payment.
- All payments are non-refundable unless Photographer is unable to perform services.
- Nature of Surprise Proposal Coverage
Client understands that surprise proposals are live, uncontrolled events. Photographer is not responsible for:
- Changes in timing
- Delays caused by Client or third parties
- Proposal happening earlier or later than scheduled
- Weather conditions
- Venue restrictions
- Crowds, security interference, or public obstruction
- The proposed partner declining the proposal
Photographer will make every reasonable effort to capture the proposal moment but cannot guarantee specific angles, expressions, or environmental conditions Client is responsible for clear communication of:
- Exact proposal location
- Backup location
- Timing window
- Clothing description for identification
- Any code word or signal to confirm the proposal moment
- Client Responsibilities
If venue security, park staff, hotel management, or property owners restrict photography, Photographer is not liable for missed images. Client agrees to:
- Arrive on time
- Follow the agreed-upon proposal plan
- Notify Photographer immediately of any timeline changes
- Confirm any permit requirements for public or private locations
- Rescheduling Policy
Weather-related reschedules are permitted when safety or severe weather conditions are present, subject to availability. Because proposal dates are often tied to travel or special plans:
- One reschedule is allowed with at least 72 hours notice, subject to availability.
- Reschedules within 72 hours may require a new retainer.
- Same-day cancellations or no-shows result in forfeiture of all payments.
- Image Delivery
- Final edited images will be delivered via online gallery within 7 days of the proposal date.
- Gallery delivery timelines may vary during peak seasons.
- RAW, unedited files are not delivered.
- Photographer maintains full creative control over editing style and image selection.
- Usage & Copyright
Photographer reserves the right to use images for portfolio, website, social media, advertising, and promotional purposes unless otherwise agreed in writing. Photographer retains full copyright to all images. Client receives a non-transferable, personal-use license to:
- Share on social media
- Print for personal use
- Announce engagement
Images may not be:
- Sold
- Edited beyond basic cropping
- Submitted to vendors, publications, or blogs without written permission
- Force Majeure
Photographer is not responsible for failure to perform due to circumstances beyond reasonable control, including but not limited to acts of God, government restrictions, travel disruptions, illness, natural disasters, or venue closures.
- Model Release
Unless otherwise agreed in writing, Client grants Photographer permission to use images for portfolio and promotional purposes.
If the proposal must remain confidential (for professional or personal reasons), Client must request a confidentiality addendum in writing prior to the event.
- Dispute Resolution
This Agreement shall be governed by the laws of the state in which services are performed. Any disputes shall be resolved through mediation prior to litigation.
